PRIVACY POLICY

This Privacy Policy explains how LBSTR Concept Kft. (the Data Controller), operator of www.themostdaily.com, processes the personal data of website visitors and customers in accordance with the EU General Data Protection Regulation (GDPR 2016/679) and applicable Hungarian laws.

2. PURPOSES, LEGAL BASES AND RETENTION PERIODS

The webshop may not be used by persons under 16 without the consent of their legal representative. The Data Controller cannot verify the authority of the consenting person, therefore the customer is responsible for ensuring that the provided data is accurate.

For purchases and contract fulfilment, the Data Controller processes name, billing and shipping address, email address, phone number and order details on the legal basis of contract performance. These data are retained for the civil limitation period of 5 years. For invoicing, the Data Controller processes invoicing data on the legal basis of legal obligation and retains accounting records for 8 years. For user registration, name, email address, encrypted password and order history are processed on the basis of consent until account deletion. Newsletter data are processed on the basis of consent until withdrawal. Complaint handling data are retained for 3 years under consumer protection rules. Website operation and cookies may involve IP address, browsing data and device information depending on the cookie type and consent settings.

3. PROCESSORS AND DATA TRANSFERS

The Data Controller uses processors that provide technical and operational services necessary for the webshop:

  • Shopify Inc., 151 O'Connor Street, Ground Floor, Ottawa, ON K2P 2L8, Canada, provides the webshop platform, hosting and Shopify Email newsletter system. Shopify processes order, customer, transaction and technical data necessary to operate the webshop. Shopify’s consumer privacy information is available at https://www.shopify.com/legal/privacy/consumer.
  • Webshippy Fulfillments Kft., 1044 Budapest, Ezred utca 1-3. B2/11., provides warehousing and fulfilment services.
  • Delivery providers: Foxpost Zrt., GLS General Logistics Systems Hungary Kft., Magyar Posta Zrt. - MPL, Express One Hungary Kft., DPD Hungária Kft. and United Parcel Service Hungary Kft. - UPS receive the data necessary for delivery.
  • Billingo / Octonull Kft., 1107 Budapest, Mázsa utca 9., provides online invoicing services.
  • Payment providers: Shopify Payments (Stripe Technology Europe Ltd., Ireland) and PayPal (Europe) S.à r.l. et Cie, S.C.A. process payments. The Data Controller does not access full bank card data.

4. DATA SECURITY

The Data Controller applies security measures appropriate to the state of technology. Website traffic is protected by SSL encryption. Shopify and Billingo use encryption for data storage. Access to data is limited internally to personnel involved in fulfilment and administration. The Data Controller does not use automated decision-making or profiling under Article 22 GDPR.

5. DATA SUBJECT RIGHTS

Data subjects may exercise their rights by sending a request to hello@themostdaily.com. The Data Controller responds within no more than 30 days. Data subjects have the right of access, rectification, erasure where legally possible, restriction of processing, data portability, withdrawal of consent and objection to processing based on legitimate interest.

6. COOKIES

The webshop uses cookies for cart functionality, website operation and statistical analysis. Necessary cookies are required for the store to function, including login and cart memory. Marketing and analytics cookies are enabled only where the visitor gives consent through Shopify’s built-in cookie consent tools.

In case of infringement of rights, data subjects may bring a claim before the court competent for the Data Controller’s registered office or before the court competent for their own place of residence.
