GENERAL TERMS AND CONDITIONS (GTC)
Effective: from 19 May 2026 until revoked.
These General Terms and Conditions (hereinafter: GTC) contain the detailed terms and conditions of the legal relationship between LBSTR Concept Korlátolt Felelősségű Társaság (hereinafter: Service Provider) and the person (hereinafter: Buyer) purchasing products sold through the Service Provider's website www.themostdaily.com.

2. INTERPRETATIVE PROVISIONS AND SUBJECT OF THE CONTRACT
2.1. Consumer: According to the Civil Code (Ptk.), a natural person acting outside the scope of their profession, independent occupation, or business activity. The consumer protection provisions of these GTC apply exclusively to Buyers who qualify as Consumers.
2.2. Nature of the contract: An order placed by the Buyer is considered a sales contract concluded between the parties using a means allowing communication between absent parties.
2.3. Product range: The Service Provider primarily sells food supplements and food products (e.g., ceremonial cocoa).
2.4. Legal disclaimer: Products available in the webshop are not considered medicines and are not suitable for preventing, treating, or curing diseases. Food supplements do not replace a balanced, varied diet and a healthy lifestyle.
3. ORDER PROCESS AND CORRECTION OF DATA ENTRY ERRORS
3.1. During the purchase process, the Buyer places the selected products in a virtual shopping cart. Before finalizing the order, the Buyer has the opportunity to review and modify the data (billing address, shipping address, product quantity).
3.2. By submitting the order, the Buyer incurs a payment obligation towards the Service Provider.
3.3. The Service Provider is obliged to confirm the receipt of the order by email immediately after the Buyer's order, but no later than within 48 hours. The contract is concluded when the confirmation email becomes accessible to the Buyer in their email system. If no confirmation is received within 48 hours, the Buyer is released from their offer.
4. REGISTRATION AND USER ACCOUNT
4.1. Purchases in the Webshop can be made either by registering or as a guest (without registration). However, the subscription service (recurring order) requires the creation of a user account (registration) due to the system's operation.
4.2. During registration and purchase, the Buyer is obliged to provide the requested data truthfully. The Service Provider is not liable for delivery or billing problems resulting from incorrect, incomplete, or false data provision.
4.3. The Buyer is responsible for keeping their account password confidential. If they become aware that unauthorized persons have gained access to their password, they are obliged to change it immediately or notify the Service Provider.
4.4. The Service Provider is entitled to delete the registration and user account if the Buyer seriously violates these GTC or legal regulations.
5. PRICES AND PAYMENT TERMS
5.1. Prices displayed in the Webshop are denominated in Euros (EUR). For visitors from Hungary, the interface may also display indicative Forint (HUF) equivalents.
5.2. Prices include the legally mandated 27% value-added tax (VAT). Prices do not include shipping costs, which are accurately calculated during the checkout process.
5.3. Payment methods:
Online bank card payment: Processed securely via Shopify Payments (Stripe) or PayPal in EUR currency. For subscription (recurring) orders, only recurring bank card payments via Shopify Payments (Stripe) can be used.
Cash on Delivery: Payment to the courier upon receipt of the shipment. Cash on delivery in Hungary is made in cash, in the Forint (HUF) amount fixed by the system at the time of finalizing the order and indicated on the invoice. Cash on delivery payment method is not applicable for subscription orders.
5.4. Exchange rate and conversion: If the Buyer uses a payment instrument whose base currency is not Euro (e.g., a Forint-based bank card), the conversion will be carried out at the exchange rate of the Buyer's card-issuing bank at the time, for which the Service Provider does not assume responsibility.
5.5. Determination of shipping fees: Shipping fees are fixed amounts denominated in Euros, which include the fees of logistics partners (Webshippy and courier services). The Service Provider reserves the right to unilaterally modify shipping fees depending on exchange rate changes (this does not affect already placed and confirmed orders).
6. TERMS OF SUBSCRIPTION SERVICE (AUTOMATIC RECURRING ORDER)
6.1. Description of the service: For certain products, the Service Provider offers a convenient subscription (recurring order) model. The essence of the subscription is that the Shopify system automatically re-orders the product(s) selected by the Buyer at the chosen intervals, automatically deducts the purchase price and shipping fee from the Buyer's specified bank card (via the Shopify Payments / Stripe system), and delivers the product to the specified address, without the Buyer having to manually repeat the order.
6.2. Subscription cycles (Frequency): The length of the subscription cycle can be 3 weeks (21 days) or 30 days, depending on the product concerned. The Service Provider clearly indicates the cycle period for the given product on the product page, and the Buyer selects it during the order process. Subsequent automatic charges and orders are always due on the 21st or 30th day from the date of the very first successful transaction (anniversary date).
6.3. Term of the contract and limitation of cancellation (Commitment period):
The subscription contract between the parties is concluded for a definite period for the very first (initial) order, and the 2 (two) immediately following automatic recurring orders (i.e., a total of 3 successfully fulfilled and delivered orders).
During this definite period (commitment period), the Buyer is not entitled to ordinary termination (cancellation) rights; the subscription cannot be deleted, cancelled, or suspended in the system.
After the 3rd (third) successfully fulfilled order, the contract automatically converts into an indefinite-term contract.
The subscription contract that has converted to an indefinite term will automatically and continuously renew for an unlimited number of orders until cancellation in each subscription cycle, and will entail an automatic payment obligation on the respective anniversary date.
6.4. Procedure for cancelling a subscription:
The Buyer can cancel an indefinite-term subscription (i.e., after the completion of the 3rd successful delivery) at any time, without justification and without additional costs.
Cancellation can be done by logging into the Buyer's user account (Profile) in the menu item for managing subscriptions, or by sending an explicit written statement to the Service Provider's customer service email address (hello@themostdaily.com).
To ensure that the purchase price of the next cycle is not deducted, the cancellation must occur at least 24 hours before the next due anniversary date (scheduled charge). Cancellations received on or after the anniversary date will only apply to the subsequent subscription cycle.
6.5. Recurring payment authorization: By initiating the subscription, the Buyer gives their explicit consent and authorization for the Service Provider's secure payment partner (Shopify Payments / Stripe) to automatically deduct the current purchase price of the subscription product and its associated shipping cost from the Buyer's card on the anniversary dates, without prior, case-by-case approval.
7. FULFILMENT AND LOGISTICS
7.1. The Service Provider's logistics and warehousing partner is Webshippy Fulfillments Kft.
7.2. Domestic shipping partners: Foxpost, GLS, MPL, Express One.
7.3. International shipping partners: DPD, UPS.
7.4. The Buyer is obliged to check the integrity of the package upon receipt. If the packaging is visibly damaged, the Buyer must draw up a report with the courier or refuse to accept the package. The Service Provider will not accept subsequent complaints regarding physical damage or shortage of the package without a damage report.
8. RIGHT OF WITHDRAWAL AND ITS LIMITATION
8.1. According to Government Decree 45/2014. (II. 26.), the Consumer has a right of withdrawal without justification for 14 days from the receipt of the product. (In the case of a subscription product, the right of withdrawal is calculated from the day the first product is received).
8.2. Exclusion from the right of withdrawal (Health protection and hygiene clause): Pursuant to Section 29 (1) e) of the aforementioned government decree, the Consumer may not exercise their right of withdrawal in respect of a sealed product which cannot be returned after unpacking for health protection or hygiene reasons.
8.3. Service Provider's specific policy regarding product range:
In the case of food products and food supplements, the right of withdrawal is permanently lost if the packaging (protective film, safety seal ring, cap, ziplock) is opened or damaged to any extent.
The Service Provider is obliged to refund the purchase price only if the product is returned in its original, completely unopened, undamaged condition.
If the product's bottle, container, or external individual packaging is damaged, aesthetically objectionable (e.g., dirty, scratched), the Service Provider is entitled to refuse acceptance of the withdrawal.
8.4. In the event of withdrawal, the direct cost of returning the product to the Service Provider (or to the logistics partner's warehouse) shall always be borne by the Buyer.
9. WARRANTY FOR DEFECTIVE PERFORMANCE AND PRODUCT WARRANTY
9.1. Warranty for defective performance: In the event of defective performance by the Service Provider, the Buyer may enforce a claim for warranty for defective performance in accordance with the provisions of the Civil Code. They may request a replacement of the product, or if this is not possible, a price reduction, or may withdraw from the contract. In the case of food products and food supplements, the claim for warranty for defective performance can only be enforced within the shelf life indicated on the product (expiry date).
9.2. Product warranty: In the event of a product defect, the Consumer may demand the manufacturer or distributor to replace the product if it does not meet the quality requirements effective at the time of its placing on the market.
10. COMPLAINT HANDLING AND LEGAL REMEDIES
10.1. The Buyer may address their complaints to the Service Provider at the email address hello@themostdaily.com. The Service Provider will investigate the complaint without delay and respond in writing within 30 days.
10.2. Conciliation Body: In case of a consumer dispute, the Consumer may turn to the regional Conciliation Body competent according to their place of residence. The geographically competent body according to the Service Provider's registered office is:

11. DATA PROTECTION AND FINAL PROVISIONS
11.1. The Service Provider processes the Buyer's personal data solely for the purpose of fulfilling the order, handling logistics, billing obligations, as well as automatic management of subscriptions and tokenized processing of recurring payments, as set out in the Data Management Information.
11.2. For matters not regulated in these GTC, the provisions of the Civil Code (Act V of 2013), Act CVIII of 2001 on certain issues of electronic commerce services and information society services, and Government Decree 45/2014. (II. 26.) shall be applicable.
11.3. Jurisdiction: In the event of a dispute, the Parties agree to the exclusive jurisdiction of the Szombathely District Court. This jurisdiction clause applies exclusively to contracts concluded with Buyers who are not Consumers (businesses, B2B partners). In the case of a retail Consumer, the lawsuit must be initiated according to the statutory (general) rules of jurisdiction.
